1. What you are buying

SkinBid runs one auction round across 15 spots on one person's body. If you hold the top bid on a spot when the round closes, your design is applied to that spot as a temporary tattoo and worn for 15 days, photographed daily, filmed at the end, and tagged in every post. Nothing here is a permanent tattoo, ever.

The mechanics — opening prices, the amount it takes to beat a bid, ties, and what happens if a spot cannot be worn — are set out on the rules page and form part of these terms.

2. Who can bid

You must be 18 or older and legally able to enter a contract. If you are bidding for a company, you confirm you are allowed to commit that company.

3. The licence you grant us

By placing a bid you grant SkinBid a non-exclusive, worldwide, royalty-free licence to reproduce your design as a temporary tattoo, apply it to the body, and display it in photographs, video, live streams and social posts — for the round and its 15-day wear period, and afterwards as a permanent archive of what happened.

“Afterwards as an archive” is deliberate and it matters: the photos and video are the proof that we did what you paid for, and they stay published on the winners page and on the social accounts where they were posted. We are not going to unpublish the evidence.

Everything else stays yours. This licence does not transfer ownership, does not let us sub-license your design to anyone else, and does not let us put it on merchandise or use it to endorse a third party.

4. What you promise about your design

When you upload a design you warrant that:

• You own it, or you have written permission from whoever does to use it exactly this way.
• It does not infringe anyone's trademark, copyright, design right, or right of publicity.
• It does not break any of the content rules on the rules page.
• Everything you tell us about your brand and handle is accurate.

Bidding somebody else's logo onto a stranger's body is not a prank we are prepared to be part of.

5. Indemnity

If a third party comes after us because of your design — a trademark owner, an illustrator, an agency, anyone — you will cover our losses, and our reasonable legal costs, arising from your breach of section 4. We will tell you promptly if a claim arrives and give you a fair chance to deal with it.

6. Our right to say no

We can refuse or remove any design, at any point, for any reason we think is good — including reasons that are not on the prohibited list. When we do, that bid is refunded in full, the processing fee included, and the spot returns to its previous leader.

We can also hold a spot while we look at something. A held spot takes no new bids and its artwork stays hidden until we have decided.

7. Bids are binding once paid

A bid is an offer, and paying for it makes it binding. You cannot retract a paid bid to duck a price you no longer like. What you can do is ask to withdraw, which we will consider on the terms set out on the refunds page.

Being outbid is not a cancellation and does not need one — the refund is automatic, minus the payment processing fee.

8. This is entertainment, not an investment

A spot is not an asset. It is not a security, a share, a token, a collectible, or anything with a resale market. There is no secondary market, spots cannot be transferred between bidders, and nothing you buy here appreciates. You are paying for 15 days of attention and the photos that come out of it.

We make no promise about how many people will see your design, how a post will perform, or what it will do for your business. Don't bid money you would miss.

9. Payments

Payments are processed by Dodo Payments acting as Merchant of Record. Dodo Payments is the seller of record for the transaction, handles the card processing and any applicable sales tax or VAT, and appears on your statement as DODOPAYMENTS. We never see or store your card number.

Prices are in US dollars. Bids are whole dollars. If your card is billed in another currency, your issuer sets the exchange rate and may add its own fee, which we neither receive nor control.

10. Liability

Nothing here limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot lawfully be limited. Subject to that, our total liability to you in connection with a bid is capped at the amount you paid for that bid, and we are not liable for indirect or consequential loss — lost profits, lost reach, lost goodwill.

11. Changes

We can change these terms, but not retroactively: the version in force when you placed a bid governs that bid. Material changes get a note on this page and a new “last updated” date.
